Takedown Policy

1. Introduction

KOOKOO BUSINESS PRIVATE LIMITED (“KOOKOO,” “we,” “us,” or “our”) operates the KOOKOO application (“App”) and is committed to maintaining a safe, trustworthy, and legally compliant digital environment for our users. This Takedown Policy outlines the procedures through which users, rights holders, and other stakeholders can notify us about content that may violate KOOKOO’s Community Guidelines, applicable laws, or intellectual property rights, and how we handle requests for removal or disabling access (“Takedown Requests”).

2. Scope of the Policy

This policy applies to all content hosted or accessible through KOOKOO’s platform, including but not limited to user-generated content, posts, comments, images, videos, and other digital materials.

3. Grounds for Takedown Requests

KOOKOO processes takedown requests for content that:

• Violates KOOKOO’s Community Guidelines, including but not limited to hate speech, harassment, adult content, and illegal activities.
• Infringes valid intellectual property rights (e.g., copyrights, trademarks, patents).
• Violates any applicable laws or regulations.
• Contains defamation, privacy breaches, or personally identifiable information unlawfully shared.
• Is otherwise unlawful or harmful as determined under applicable legal frameworks or KOOKOO’s policies.

4. How to Submit a Takedown Request

To submit a takedown request, please provide the following information to our Takedown Officer via email at support@kookoo.co.in:

• Your full name, contact information, and, if applicable, your status as the rights holder or authorized representative.
• A clear identification of the content to be taken down (including URL, user handle, screenshots, or other identifying information).
• A detailed description of the violation or legal basis for the takedown request.
• Any supporting documentation or evidence of rights ownership or legal claims.
• A statement, under penalty of perjury (or equivalent legal declaration), affirming that the information provided is accurate and that you are authorized to act on behalf of the rights holder if applicable.

Incomplete or unsigned requests may not be processed.

5. Review Process and Action Timeline

• Upon receipt, KOOKOO will acknowledge the request and begin a prompt review, generally within 5 business days.
• We may remove, restrict, or disable access to the content while we investigate.
• KOOKOO reserves the right to reject or decline takedown requests that do not comply with this policy or appear to be abusive or fraudulent.
• Decisions will be communicated to the requester by email once the review is complete.
• If content is removed, the affected user will be notified and given an opportunity to respond or appeal as applicable.

6. Counter Notifications and Disputes

If you believe your content was wrongly removed or disabled, you may submit a counter-notification including:

• Your contact information.
• Identification of the removed content.
• A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
• Consent to jurisdiction for any legal action that may follow.

KOOKOO will review counter-notifications and, where legally required, may restore access unless a legal proceeding suspends the restoration.

7. Legal Compliance and Cooperation

KOOKOO complies with applicable Indian laws and international standards relevant to takedown requests. We cooperate with law enforcement agencies, courts, and relevant authorities and will act on valid legal orders.

8. Abuse of Takedown Process

Misuse of the takedown procedure, including submitting false or misleading takedown requests, may result in suspension or termination of accounts and may be subject to legal action.

9. Modifications to This Policy

We may update this Takedown Policy from time to time to reflect changes in laws, community standards, or company practices. Updates will be effective upon publication on the KOOKOO App or website.
