1. Introduction

Welcome to KOOKOO, operated by KOOKOO BUSINESS PRIVATE LIMITED (“KOOKOO,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the KOOKOO mobile application and related services (collectively, the “App”). By downloading, installing, or using the App, or by accessing our services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 18 years old or of legal age in your jurisdiction to use the App. By using KOOKOO, you represent and warrant that you meet these requirements and have the legal capacity to enter into this agreement. Users under 18 years old are not permitted to register or use the App.

3. Account Registration and Security

To use certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials.
• Accept responsibility for any activity conducted under your account.
• Notify us immediately if you suspect unauthorized use of your account.

4. License to Use the App

Subject to your compliance with these Terms, KOOKOO grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes only. All rights not expressly granted are reserved by KOOKOO.

5. User Conduct and Prohibited Uses

You agree not to use the App to:

• Violate any applicable law or regulation.
• Post, share, or distribute content that is unlawful, harmful, defamatory, obscene, offensive, abusive, threatening, or infringes upon others’ rights.
• Engage in harassment, hate speech, bullying, or discriminatory conduct.
• Upload malware, viruses, or harmful code.
• Attempt to gain unauthorized access to other accounts or systems.
• Spam, scam, or manipulate the App’s features in any way.
• Infringe copyrights, trademarks, or other intellectual property rights.

6. Content Ownership and Intellectual Property

• You retain ownership of the content you create and share on KOOKOO.
• By sharing content on the App, you grant KOOKOO a worldwide, royalty-free, sublicensable license to use, distribute, display, and promote your content within the App and related services.
• KOOKOO’s logos, trademarks, and proprietary content are owned by KOOKOO and protected by law. You may not use them without prior permission.

7. Privacy

Your use of KOOKOO is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the App, you consent to the terms of the Privacy Policy.

8. Termination and Suspension

• KOOKOO may suspend or terminate your account and access to the App at any time, without prior notice, for violation of these Terms or illegal conduct.
• You may also terminate your account by following the procedures in the App.
• Upon termination, your rights to use the App cease immediately, but provisions concerning intellectual property, liability, and dispute resolution will survive termination.

9. Disclaimers and Limitation of Liability

• The App is provided “as is” and “as available” without warranties of any kind, express or implied. KOOKOO does not guarantee the App will be error-free, secure, or uninterrupted.
• KOOKOO disclaims liability for any damages arising from your use of the App, including data loss, loss of profits, or third-party actions.
• To the maximum extent permitted by law, KOOKOO’s total liability arising out of or in connection with your use of the App shall not exceed the amount paid by you, if any, for accessing the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless KOOKOO and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses arising from your violation of these Terms or misuse of the App.

11. Modifications to Terms

KOOKOO reserves the right to update or modify these Terms at any time. We will notify you of significant changes via the App or email. Your continued use of the App after changes constitute acceptance of the updated Terms. Regularly review these Terms to remain informed.

12. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
• Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of courts located in Junagadh, Gujarat, India.

13. Third-Party Links and Services

The App may contain links to third-party websites or services not controlled by KOOKOO. We are not responsible for their content, policies, or practices. Access third-party sites at your own risk.
